HYDERABAD: The Telangana Real Estate Regulatory Authority (TGRERA) has directed Bhrigu Infra to refund 20 lakh to a complainant who invested in their villa project, ‘Bird of Paradise’, at Thimmapur village, Shamshabad mandal, Rangareddy district.
The complainant alleged that the respondent failed to register the villa plot in the complainant’s name, despite collecting payment and promising registration within a few months.
The complainant stated that an agent, representing Bhrigu Infra, enticed them to invest in a 240 square yard villa plot at a rate of 16,000 per square yard with an upfront payment of 20 lakh.
Despite assurances and the provision of an HMDA approval letter, the respondent did not deliver the plot and has since become unreachable. Following multiple hearings, during which the respondent admitted to collecting the payment, the realty firm failed to register the plot due to unresolved legal disputes with the landowner.
After reviewing the case, TSRERA directed the respondent to refund the full amount with 10.85% interest from the date of payment until repayment, within 45 days. TGRERA also imposed a penalty of 39,600 for Bhrigu Infra’s violation of Section 10 of the Real Estate (Regulation and Development) Act, 2016, which prohibits agents from facilitating sale of unregistered projects.
Additionally, the authority ordered the respondent to cease all sales and marketing activities related to unregistered projects, warning of further penalties under Section 62 of the Act if violations continue. TGRERA concluded the case, noting that any aggrieved party might appeal to the Telangana Real Estate Appellate Tribunal under Section 44 of the Act.
This decision underscores TGRERA’s commitment to enforcing compliance and protecting the interests of homebuyers under the Real Estate Act, 2016.
