BENGALURU: The Karnataka Real Estate Regulatory Authority (K-RERA) directed a developer to constitute and register the association of allottees before the competent authority in accordance with applicable law within 60 days.
Delivering an order after hearing a complaint filed by Swetha Rangaswamy who bought a flat developed by Eco Life Developers, the K-RERA said that the respondents have to take the necessary steps within their legal obligations to facilitate their completion, if any statutory formalities remain incomplete.
Rangaswamy lodged a complaint with the K-RERA stating that she and other allottees were waiting for the respondents to facilitate the formation and registration of an association of allottees before the competent authority and to transfer the common areas and the corresponding rights and title thereto in favour of such association, in accordance with the provisions of the Act, 2016. “However, despite the completion of the apartments and handing over of possession to the allottees, the respondents have allegedly failed to complete the aforesaid statutory obligations,” she said in the complaint.
The complainant alleges that when the allottees requested the respondents to provide proof of registration of the association, the respondents claimed that an association had already been registered under the Karnataka Apartment Ownership Act, 1972 but they failed to furnish a Certificate of Registration issued by the competent authority to support their claim.
The K-RERA, in an order, directed the respondents to complete the requirements within their statutory obligations under Sections 11(4)(f) and 17 of the Act, 2016, and execute the requisite conveyance or other transfer documents relating to the common areas and undivided proportionate title in favour of the association of allottees or competent authority, as applicable.
