HYDERABAD: Telangana Real Estate Regulatory Authority (TG RERA) on Monday ordered penalty proceedings against two real estate agents for facilitating plot sales in the unregistered ‘Amber Homes’ project at Mucherla village in Rangareddy district, and directed the landowner to stop marketing or selling plots until the venture is registered with the authority.
The order was issued on a petition filed by J Ravi Kishore against SKA Realtors Limited Liability Partnership, Rosi Reddy of developer Lavoura Developers Private Limited and Durga Devi of Talking Bricks Group of Companies.
TG RERA held that ‘Amber Homes’ was a real estate project and that plots were sold without the mandatory registration required under Section 3(1) of the Real Estate (Regulation and Development) Act.
Buyer paid ₹1.17 crore for 1,000 sq yards
Kishore said he had agreed to buy a plot, measuring 1,000 square yards, for ₹1.15 crore. He claimed to have paid ₹1,17,61,000, including registration charges.
Of the total land, 500 square yards were registered in his name in Feb 2024. Registration of the remaining 500 square yards was repeatedly deferred despite the full payment, he alleged. Kishore told the authority that disputes among the landowner, developer and real estate agent were cited to delay execution of the final registration.
SKA Realtors contended that the project had commenced before the RERA Act came into force and was, therefore, not registered under the law. It alleged that Rosi Reddy had acted without authorisation and used the company’s name to collect money.
The landowner (SKA Realtors) expressed willingness to register the plot but denied responsibility for money allegedly collected by Rosi Reddy without its consent.
Durga Devi said ‘Amber Homes’ was a Hyderabad Metropolitan Development Authority-approved layout, but its registration with TG RERA could not be completed due to disputes between the landowner and developer. She maintained that she was a registered real estate agent and denied the allegations against her.
Landowner told to stop plot sale
TG RERA found SKA Realtors in violation of Section 3(1) and issued a cease-and-desist direction, restraining it from further advertising, marketing or selling plots in ‘Amber Homes’ until the project is registered with the authority.
The authority found that Rosi Reddy had violated Section 10(a) by facilitating transactions in an unregistered project. It also declared him a defaulter for misrepresentation and unfair conduct, observing that he had presented himself as a “vendor/developer” without legal authority while concealing his status as a registered real estate agent.
The TG RERA secretary was directed to initiate proceedings for imposing a penalty on Rosi Reddy under Section 62 of the Act.
Durga Devi was also found to have violated Section 10(a) by facilitating transactions in the unregistered project. The secretary was directed to initiate steps to impose a penalty on her under Section 62.
The authority recorded that SKA Realtors completed the registration of the remaining 500 square yards in Kishore’s favour during the pendency of the proceedings.
