NEW DELHI: The Uttar Pradesh Real Estate Regulatory Authority (UP-RERA) has enabled online complaint filing against promoters and developers demanding transfer charges beyond the prescribed limits during allotment transfer.
Homebuyers and allottees can file complaints through Form-M on the UP-RERA portal. The mechanism has been made operational after the implementation of the 10th amendment to the UP-RERA General Regulations, 2019.
Under the amended Regulation 47(c), promoters cannot execute a new or revised agreement for sale or lease with the assignee or successor-in-interest. The transfer has to be recorded through an endorsement in the existing agreement, along with necessary updates in the promoter’s records.
In case of the death of an allottee, if the successor-in-interest is a family member, the promoter cannot charge a processing fee of more than ₹1,000. The successor will have to submit documents such as the death certificate of the original allottee, succession certificate issued by the competent authority and no-objection certificates from surviving legal heirs.
For transfer or assignment to another family member, the maximum processing fee has also been capped at ₹1,000. In cases where the assignee or successor-in-interest is not a family member, the promoter cannot charge more than ₹25,000 as processing fee.
Any demand above the prescribed limit can be challenged before the authority through the online complaint filing system.
